  • Mediation is in fact negotiation assisted by a third, unbiased party referred to as mediator. The parties involved in a dispute try to reach a mutually beneficial solution. The mediator helps both parties to communicate effectively to identify the problems and obstacles, and to find ways of amiable resolution. The solution always lies in the hands of the disputants, as does the responsibility of putting it into practice. The mediator is there to set the scene for the discussions between the parties, in a secure and confidential environment, and to make them run as smoothly as possible. The mediator makes sure each participant gets their say, makes their interests, needs and wants clear to the others, and that the final agreement addresses all the legitimate needs and interests involved. Mediation is a way to amiably resolve conflicts, which works very well if the parties involved seek to reach a mutually beneficial agreement, and which requires the assistance of an expert in communication and negotiation - THE MEDIATOR.

Prin mediere, partile implicate într-un litigiu încearca sa identifice solutia care le satisface deopotriva. Mediatorul ajuta partile sa comunice efectiv si corect, sa identifice problemele si obstacolele cu care se confrunta si sa gaseasca posibilele cai de întelegere amiabila. Solutia litigiului apartine partilor, asemeni si responsabilitatea implementarii acesteia. Mediation

There are several kinds of disputes that can be resolved by mediation, such as civil, family, business, criminal or other disputes – so long as the conflicting parties can benefit from the rights involved. In other words, divorce itself, for example, cannot be gotten by mediation (divorce must be pronounced by the court, the city clerk, or the public notary – depending on the case), but here mediation can help structure the separation agreement, the custody of the children, the amount of alimony, and so on.

You should choose mediation if:

1. You want the negotiation with the other party to be confidential – no publicity or paparazzi, away from scrutinizing eyes

2. You want to resolve your dispute in a relatively short time (historically, not geologically, if possible), within the frame of a few number of meetings held over a period of days or weeks (depending on the time you can spare for resolving the issue), rather than months or years

3. You prefer to be the key decision factor in the way the issue is resolved, rather than allow that the decision be taken by other entities (such as the court of law – which sometimes unfortunately reminds us of the lottery rather than justice)

4. You want the resolution meetings to be scheduled when you have the time and mood, not when you are summoned or subpoenaed irrespective of your availability

5. You are interested in completely burning out the dispute, so that you may peacefully carry on with your life without being bothered by the nightmare of insecurity, ineffectiveness, growing court bills, corruption and incompetence, and by recurring ill feelings generated by a conflict which constantly reappears in your life.

If you decide to benefit from the services of the Christian-Radu Chereji Mediation Office, you will have the opportunity to be consulted by an expert in the decision-making process and amicable dispute resolution, with over 15 years’ academic and research experience and 7 years’ practical experience. My specialty is in the area of community conflicts (neighborhood conflicts, disputes between citizens and public institutions, or between private enterprises and public entities, public policy development, resource allocation, environmental protection and sustainable development of the community – especially rural areas) and organizational management conflicts (conflict between employees and employers, between organization departments, organization related disputes, human resources management, objective setting, strategic planning, resource allocation and evaluation, decision-making processes, competitiveness, and productivity), but I am also available to help you solve any other type of problem – family, civil, penal, organizational, business.

We will begin our collaboration by analyzing and evaluating your problem, so that together we can  identify the  proper procedures  for solving it. If your problem involves legal aspects, it is advisable that your lawyer be present also. If you do not yet have your own lawyer, we can call on a matter expert together with whom we have a partnership agreement. Once we set an initial strategy, I will discuss with the other side(s) and try to get their consent to participate to the mediation process. Up to this point, there are no charges or fees, unless I need to travel outside Cluj-Napoca for these purposes.

Further on, we will draw, together with all the parties involved, the necessary papers, we will settle the participation in the meetings and the fee for the mediation services. All these decisions are to be taken only with your explicit and informed consent. Afterward, we sign the mediation contract and we begin the meetings, all the way focusing on finding the best solution for the issue you are facing. You will have constant counseling and support from my part, we will explore the most diverse aspects of your problem, centering on your (all the parties) needs, and we will seek the most effective way of resolving the matter and at the same time respect everyone’s needs and interests.

In the end, we will draw a mediation agreement in which we will nail down all the decisions which you – the parties involved in the dispute – have deemed useful in settling the matter. You will then refer to a legal consultant in order to verify the legality of all the decisions taken. You will benefit from the mediator’s support in implementing the terms of the agreement settled, so that the outcome of the mediation be the complete termination of the dispute, rather than a worthless piece of paper or an unfair or unfeasible court sentence.

The fees are proportional with the workload involved in resolving the dispute, not with the value of your disputed objects or transactions. Mediation ethics forbids relating fees to the value of goods of transactions that are the object of mediation. I personally apply the principles of the ethics code and I understand to obey both the letter and spirit of the law, because I value my reputation as mediator more than any other amount of money I could gain otherwise.

We will establish the fee together, according to the complexity of your case, to the number of parties involved, to the need to travel outside Cluj-Napoca during and in the interest of the mediation process, and to the estimated length of the process. Just to give you an idea, the minimum fee is 300 lei for natural persons, for a mediation meeting that lasts  up to 4 hours and there is an added 150 lei for each additional hour of mediation. The fee can be negotiated in special situations, for the entire case and set at a minimum of 600 lei per two weeks of work in total. For legal persons, the starting fee is 600 lei for the mediation meeting, with an additional 300 lei for every extra hour, or a 1500 lei package for 2 weeks’ work in special cases. Of course, the fee is split between the parties involved (preferably in equal parts). For instance, in the case of a separation arrangement between two spouses, each one will have to pay a minimum amount 150 lei for the 2-4 hours mediation session which costs 300 lei.

Taking into account certain peculiarities that cases might present, other arrangements can be made related to the fees, to the means of holding the meeting (teleconference, videoconference, email, Skype, and so on), and to the location – to suit your needs and the specifics of the issue.

Training, mentoring, coaching

A variety of trainings and courses of initiation are available at the Transylvanian Institute of Mediation. I can deliver, by the same means, a series of specialized courses or courses with special destinations (companies, public institutions, NGOs). These courses focus on ways and means used in decision-making, conflict management, amicable conflict resolution with a view to sustainable development and environmental protection, and crisis management. The course curriculum is developed according to each client’s needs, and the fees are subject to negotiation – depending on the workload.

I am a certified senior trainer (certification awarded by the Mediation Council by the Decision number 987/06.06.2008), a PHD  senior lecturer at the Communication and Public Relations Department of the  School of Political, Administrative and Communication Sciences, Babes-Bolyai University (BBU) in Cluj-Napoca (since 1995). I also fulfill the role of national evaluator in the field of mediator formation and training, and of consultant of the Mediation Council in matters of forming mediators and promoting mediation in Romania. I have experience in the field of public policies (development, decision-making, crisis and conflict management, and resource allocation) and organizational management (setting objectives, drawing business, operational, risk management, human resources management strategic plans, implementing conflict management systems). I am the founder of the Conflict Studies Center within BBU, the founder of the Ultrasilvam Mediators Association, the founder and general manager of the Transylvanian Institute of Mediation. I am a member of Amnesty International, International Studies Association,and Mediators Beyond Borders.
